Acutance Privacy Policy

This Privacy Policy explains how CHNH, LLC (“CHNH,” “we,” “us”) collects, uses, shares, and retains information in connection with Acutance — our service available at acutance.app and through our mobile apps (the “Service”). It applies to account holders (“customers”), to visitors of acutance.app, and — as described in Section 3 — to people whose information our customers store in the Service.

The Service is offered in the United States.

1. Information We Collect from Customers

Account information. Email address, name, and a password (stored only as a salted cryptographic hash). If you sign in with Apple or Google, we receive your email address and a provider identifier; we never receive your provider password.

Content you store. Equipment records (including serial numbers, purchase prices, and receipts), photographs, valuations, notes, contacts, bookings, projects, packing lists, forms, document templates, documents, invoices, events and their RSVP lists, review and form responses, and location notes. Photographs may include embedded metadata, such as the time and place they were taken. This is your data; we process it to provide the Service (see Section 4).

Billing information. Payments are processed by our merchant of record (Lemon Squeezy) for web purchases, or by Apple or Google for app store purchases. We do not receive or store your payment card number. We receive transaction records from those providers — such as a customer identifier, subscription identifier, plan, amount, and status — to activate and manage your subscription.

Technical and log information. When you use the Service we record standard technical data: IP address, browser or device user agent, referring page, timestamps, and security events (such as sign-ins, password resets, and rate-limit hits). The apps and website do not use third-party advertising or analytics trackers, and the website serves its own fonts and assets rather than loading them from third-party servers. The web app uses only the cookies and local storage strictly necessary to keep you signed in and operate the site — an authentication token and interface preferences — which persist until you sign out or they expire. Sign-in providers (Apple, Google) may set their own cookies during authentication under their own policies. Because we do not sell personal information, share it for cross-context behavioral advertising, or use targeted advertising, there is no sale or sharing for browser signals such as Global Privacy Control or Do Not Track to opt out of; if our practices ever change, we will update this Policy and honor applicable opt-out signals before any such activity begins.

Communications. If you email us or submit the contact form, we keep the correspondence.

2. Information We Collect from Website Visitors

The public parts of acutance.app (marketing pages, the waitlist and contact forms, public inquiry and review forms, event RSVP pages, and public document, invoice, and signing pages) log IP addresses, user agents, and referring pages for security and abuse prevention, including rate limiting and spam filtering.

3. Information Our Customers Store About Other People

Acutance is a tool photographers and production professionals use to run their business. That means customers store information about their clients and contacts: names, email addresses, phone numbers, addresses, inquiry form responses, booking details, event RSVPs (including party size and any answers you give), review and feedback responses, invoices, and signed documents.

For this information, the customer is the data controller and CHNH is a processor/service provider acting on the customer’s instructions. We use it only to provide the Service to that customer, we do not use it for our own purposes, and we do not sell it.

If you are a client of an Acutance customer — for example, you filled out an inquiry form, RSVP’d to an event, left a review, or signed a document sent to you — your relationship is with that customer, and requests about your information should go to them. Note that a form or review link sent to you personally may include an identifier that attributes your response to you even where the form does not ask for your name. We will refer any request we receive directly to the relevant customer. Where a request concerns a signed document, each party may have an independent legal interest in retaining and accessing its own copy; each party is responsible for downloading and retaining the completed document and signing record made available through the Service.

Document signers. When you sign a document through the Service, we record your typed name, email address, IP address, browser user agent, the consent text you agreed to, timestamps, and a cryptographic hash of the document as it existed when you signed. This audit trail exists to make the signature attributable and verifiable, is retained with the signed document, and is disclosed in the Electronic Records and Signature Consent shown before signing.

4. How We Use Information

We use the information described above to: provide, maintain, and secure the Service; authenticate you; process subscriptions and entitlements; generate the outputs you request (exports, insurance schedules, PDFs, thumbnails — uploaded images are resized server-side); send transactional email (verification, password reset, document delivery, receipts, and service notices); prevent fraud and abuse; comply with legal obligations; and, in aggregate or de-identified form, understand usage and improve the Service.

We do not use your content or your clients’ information to train artificial-intelligence models, for advertising, or for any purpose other than operating the Service.

5. How We Share Information

We share information with:

We maintain a current subprocessor list at this section; material changes will be reflected by updating this Policy.

Legal and safety. We may disclose information if required by law, legal process, or governmental request, or as necessary to protect the rights, property, or safety of CHNH, our customers, or the public.

Business transfers. If CHNH is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction; this Policy would continue to apply to it, and we would provide notice of any change in ownership.

We do not sell personal information and do not share it for cross-context behavioral advertising.

6. Data Retention

While your account is active, we retain your content until you delete it. Deleted photos and records are removed from live systems and age out of backup copies on a rolling cycle of up to 90 days.

When you delete your account: deletion begins with a full export of your account data — including completed documents and their audit records — which must be downloaded or expressly declined before deletion proceeds, followed by a 30-day pending period during which you can change your mind. After that, your account and content are permanently purged, with these exceptions:

  • Signed documents and their audit trails are deleted with your account. We are not a permanent records custodian: each party to a document is responsible for retaining the copy made available at signing, and the pre-deletion export includes all completed documents and audit records. We retain a limited deletion log — that deletion was requested, that the export was generated and was downloaded or declined, the relevant dates, and the Terms version in effect — without retaining the documents themselves. Unsigned drafts are deleted with everything else.
  • Anonymized billing event records (amounts and dates with your identity removed) are retained for revenue and tax reconciliation. Payment records held by Lemon Squeezy, Apple, or Google are retained by them under their own policies and legal obligations.
  • Security and authentication logs are retained up to 12 months in the ordinary course; after account deletion, remaining entries are de-identified within 90 days. Short-lived abuse-prevention records (such as rate-limit counters) are cleared on a rolling basis measured in days.

Other categories. Electronic-signature audit trails are retained with the signed document they authenticate, for the same period as that document. Subscription and entitlement records are retained for the life of the account and anonymized afterward as described above. Support correspondence, contact-form submissions, copyright (DMCA) notices, and legal notices — including arbitration opt-outs — are retained for as long as reasonably necessary to address the matter, exercise or defend legal claims, and comply with law; arbitration opt-outs are retained for the duration of the account relationship and for as long afterward as reasonably necessary to establish or defend the validity of the opt-out or to resolve a legal claim. Where this Policy does not state a fixed period, we keep personal information only as long as reasonably necessary for the purpose it was collected, then delete or de-identify it. We may retain information longer where required by law, legal process, or a litigation hold.

7. Security

We use TLS encryption in transit, salted password hashing, signed expiring URLs for stored images, per-account data isolation, rate limiting, and off-site backups transferred over encrypted connections. No system is perfectly secure; if we learn of a breach affecting your personal information we will notify you as required by applicable law.

8. Your Rights and Choices

Access and portability. You can export your complete data at any time using the built-in export tools (JSON, CSV, and archive formats).

Correction. You can edit your account information and content directly in the Service.

Deletion. You can delete individual records at any time, and you can delete your entire account in the app or at acutance.app/account/delete.

Depending on your state of residence (including under the California Consumer Privacy Act and similar laws in other states), you may have additional rights — to know, correct, delete, or obtain a copy of your personal information, to opt out of sales or targeted advertising (we do neither), and to not be discriminated against for exercising rights. To exercise any right, use the in-product tools or email legal@chnh.llc; we will verify the request via your account email and respond within the time required by applicable law. You may use an authorized agent where the law provides for one.

9. Children

The Service is a business tool for adults. It is not directed to children, and we do not knowingly collect personal information from anyone under 13 (or knowingly allow anyone under 18 to hold an account). If you believe a child has provided us information, contact legal@chnh.llc and we will delete it.

10. Where Data Is Processed

The Service is hosted in the United States (currently in Boston, Massachusetts), and uploaded files are stored using Cloudflare R2 with a location preference in Eastern North America, subject to Cloudflare’s infrastructure and service terms. If you use the Service from outside the United States, you understand your information will be processed where our infrastructure is located.

11. Changes to This Policy

We may update this Policy. For material changes we will notify you by email or prominent notice in the Service at least 30 days before the change takes effect. The effective date above always reflects the current version.
